trey: good evening thank you for joining us i'm trey gowdy it is "sunday night in america", the blood of american soldiers was spilled again this past week and s3 u.s. service members were killed and 40 more wounded during a drone attack at a base in jordan, all americans feel a sense of loss but the burden of grief is shoulder primarily by family and friends. >> reality probably will not set in until we travel to go see her name, that is the time that i really not looking forward to i'm dreading it actually. >> she was goal oriented and she love the service and she loved serving our country. trey: iran's fingerprints are all over the bodies of those dead and wounded americans, around and its proxies have been attacking u.s. troops in assets for months now.

unfortunately the biden administration has taken the opposite approach where they have given the regime $6 billion in the regime uses the money to support hezbollah and other proxies to attack american troops, israel and her allies around the region. we were very successful at deterring iran. there were no major attacks by hamas or hezbollah when we were in office. president trump put in place a foreign policy that was very effective in the middle east and he defeated isis, we took a number of terrorist off the battlefield including soleimani. but now the middle east has gone back to the old middle east of terrorism on an almost daily basis. trey: the biden administration is calling for a two state solution with respect to palestine you served in more than one republican

administration and my memory serves me correctly. what is the answer to the conflict more broadly in the middle east and in particular to respect to the palestinian sta state. >> when i saw the state department was considering unilateral recognizing palestine i did not quite know what that means. right now is 72% of palestinians supported the terrorist attacks of october 7 on israel and. if the biden administration were to recognize the state of palestine what are they recognizing and what would they be emboldening. right now the territory of palestine half of it is controlled by hamas which is an organization that we recognize as a terrorist organization in the end of the west bank you have something like over 80% of palestinians supported the attacks on october 7. i think the biden administration is getting dangerously close to endorsing terrorism at this

lying to the america public in many cities been asking republican since day one to give them the authority to close the border, he took over when we had the largest secure border president trump security using existing law and president biden dismantled all the successful programs that trump put in place to secure the border. so the problem that negotiators have had dealing with this in administration and democrats editors is at president biden in the democrats wanted open borders, they cause the problem to the root cause and from my standpoint what the negotiation has been all about is getting democrats political cover now that mayor adam sandler johnson in new york city and chicago are screaming that joe biden is letting this country destroy their city they're not looking for a solution at the border looking for federal funding to treat migrants better which will

cause more migrants to want to come. the democrat position from my standpoint is absurd, this president had all the authority to secure the border and he's the one that caused the crisis and that's almost an insurmountable problem in negotiating with them to actually secure the border how do you force the hand of the lawless president. trey: you raise an interesting point senator, sometimes in politics, the issue is more beneficial than the solution. i hope that is not true when we have a crisis like we have at the border but sometimes politically people benefit from the issue more than a solution. before i let you go, is there any prospect forgetting something meaningful and constructive between now and the election or do we have to wait and see who wins the next presidential race. >> that'll be up to democrats. republicans want to secure the border. this is a top priority, i've setting conference i would not only vote i would promote a bill

to "sunday night in america". trey: welcome back to "sunday night in america". december 18 of last year the colorado supreme court kicked the leading gop presidential candidate off the ballot citing the 14th amendment. colorado does not however, have

the last word. this thursday the supreme court of the united states hears oral argument in the case. a careful listener will be able to tell which way the court is leaning based on which justice ask which questions. regardless and has the potential to be a monumental decision. does the 14th amendment apply in the absence of a charge or a conviction? will the high court pass the buck and say it's up to congress or the people at the ballot box? this case has become something of an economic boom for constitutional warriors as dozens of groups have filed friend of the court briefs arguing for or against kicking trump off the ballot. just across the street from the supreme court, member of congress caught the attention of the d.o.j. missouri congresswoman cori bush is best known for wanting to defund the police for you but not for herself. she spent a lot of money on her own security, was a government money or campaign funds or does

it matter legally? what are the limits on spending public or campaign money and can you have a family member on the payroll. joining me to analyze everything from law to speech or debate is former d.o.j. prosecutor jim trusty, it is great to see you. the colorado supreme court is full of democrats and even some of them don't think that trump should be kicked off the ballot. what you expect the high court of the united states to do. >> i expect them to shut this down. i really do. there is a lot to look at. if you justice roberts and trying to command a real strong majority on a 728190. you probably focus on the foundational or procedural aspects of the problem with the colorado case. that might mean for instance they decide article three of the 14th amendment does not mean the president when he refers to

officers or a federal question that states should not have the determinations of. there is a lot that can be done on the procedural ground in the field like safer territory for justice roberts in getting to the meat of the issue. the meat of the issue is a due process of the ridiculous minitrials weather in maine or this wouldn't colorado and the trial was essentially two things and as an old prosecutor and trial lawyer i'm sure you have the reaction. one was adopted j6 committee report and consider the evidence of insurrection which is rife with problems because the political nature of the committee and the way they conducted it. they brought in a sociology professor to be the trump dog whisperer interpreter and he said i know president trump said be peaceful and patriotic your honor but what he really what is the violin unpatriotic. this infected the colorado

process. i would love for them to get to the due process, the substance of the hearing but that would allow all the other states to poke the bear and continue to litigate eligibility and find a procedural basis like it doesn't apply to the president because of the legislative intent which is the district court in colorado found. then you ended all the litigation across the country. i think that's probably where were going even though lawyers go poor betting on the supreme court. trey: i feel so stupid. it never occurred to me to call a sociology professor as a witness in one of my trials. mistakingly called witnesses were people who had first-hand knowledge. you mentioned a nonexempt opinion. i say they are rare but they are rare and high-profile contentious cases. but if it is a fractured opinion along an alleged ideological line then it is going to further

undercut the legitimacy of the court it is going to be politicized wants to once again, don't you think? >> that is the thing you a sitting president who is quite comfortable demonizing the supreme court even when it student loans when they say going and we're going to lose of the supreme court. i hate to see one institution in the government sabotaging another for their own skin. i think you get a lot of that with a lot of media help as well. if it is 6 - 3 unconservative lines, you're going to hear the supreme court reform course jumping let's stack the deck and add another 20 lawyers to the supreme court. i think that's unfortunate and unfortunate that roberts is a little too sensitive to criticism. i think they should be pretty bold about establishing what the constitution says or doesn't say and they should damn the politics little bit. processes could be the safer territory than substance.

among the first to endorse him, what did you see way back then. >> peggy and i were invited to a dinner they were having a series of them following all the candidates back in 2016 this is actually late 2015 when we met him i got to know him and i endorsed him in february. we liked him. the crowd did to, they went wild over him, he has something different, he is strong and experienced in right now he's the most experience one out there having a release for four years as president. but i think most people agree even more than they were then and we have our enemies creeping all over the world. in the border we have no border anymore. military is depressed not meeting their quotas, that is a bad sign.

we have good judges of the u.s. supreme court, that is good. he is a strong man he is the strongest candidate we've had. right now what we need is his strength in the experience that he has. we are lucky he's willing to run again for this office because the times right now and the threats that are facing america all over the world and even our border require the strength that he has. trey: some of the recent polling is very good for the former president especially in swing states. there is other polling that suggests that he has a problem with some female voters. you've been on the ballot and been successful what advice would you have for him on how to bridge whatever gap exists perhaps among female voters. >> i don't know where the gap come from. another is a lot of

misinformation and i see things on other stations and other channels another broadcast that are way off base in the way that they describe them and it's only natural if you watch those stations and those people that you go get a bad impression but anyone who meets donald trump around south carolina, many women are just crazy about him but he is depicted so harshly i think it's only natural that some people who don't see the other side and don't get to see the other side or don't see the man himself and don't see the truth about him, they're not going to like him based on what they hear. but i'll tell you what he lights up the room, we had him and pickens over the summer as small town in upstate, you're familiar with it. less than 4000 people today, we had somewhere between 55 and 70000 people that turned out and he stood there for hours to see

realistically does she need to win south carolina to stay in the race do you think? >> i would say if she were to win, that would be a big boost, i don't think that's going to happen you would have to talk to the experts in listen to what they would say what would be good and what would be bad. i don't think any candidate who would be running now is going to be donald trump and south carolina. but she is a strong competitor but donald trump is a strong competitor and not only is he a strong competitor but he is a leader that the world knows and the last thing our enemies want out there is for donald trump to be president again. if donald trump is not president again and anybody else's president again. joe biden wins reelection, i

there is so many efforts of groundswell and a lot of energy on the hill in the states to actually do something about this and impose costs on some of the companies and the actors that are propagating the synthetic information for ill. trey: i guess my simple mind goes to two explanations but you're very complex mind may come up with more. i think it's a lack of criminal sanction because people think it's a first amendment issue which i don't get were questioning technology just happening faster than politicians can react or is there another explanation for the absence of a sanction? >> i think it is mostly the second one. i have the same technology development always outpaces an attempt to govern it in the people building the technology understand that as well. they know they have the edge. working in the big tech companies the east those was billed and shift and ask for

forgiveness later. we know our legislators are outmatched in their building the technologies and the thing is i think a lot of those founders in the companies people building the technologies need to understand that if they build it them bad actors will exploit it, they need to start from the premise, billed accordingly and frankly there needs to be a retroactive legislation a policy that established deterrence and away. iimposing the cost on bad actors that exploit and use the technologies even if they were created for good and then you deter some of the bad effects you mitigate the bad effects enter information environment. trey: it is hard enough for some folks to separate what is true from what is false. i think so-called artificial intelligence is making all the harder. thank you for shedding light and

to influence the jury, the trial judge is a former chief justice of the south carolina supreme court. she made a reference to the siren call of celebrity. leading people to do unwise and improper things, one member of the jury indicated that hill's comments may have influenced the jury but that juror was deemed to have given conflicting answers. the net result s murdaugh remains in prison for life. for now. bubut it highlights how hard it is to get a conviction and keep this it was almost a new trial granted not because of something that prosecutors or cops or trial judge did but because someone wanted to be famous, which hig highlights a tale, be careful what you wish for, so now she is famous for all

of the wrong reasons. >> one of history's greatest histories may -- mysteries may have been solved, could ame. amelia earhart's plane have been found all of these years, she was an aviation pioneer. iin in 1937. she was last seen. she did not make it. and where her bleaf plane went down has been one of history's greatest mysteries, an ocean exploration company in charleston, south carolina found something resembling a plane on the ocean. we don't know for sure if it is her plane.
